Nekonomikon Co., Ltd. ("Nekonomikon," "we," "us," or "our") operates the Hi / Hi, world mobile application and related services (collectively, the "Service").

This Privacy Policy explains how we collect, use, disclose, store, and otherwise process information when you use the Service, and describes the choices and rights available to you.

By using the Service, you acknowledge the practices described in this Privacy Policy.

If you have questions about this Privacy Policy or how we process your information, please contact us at:

1. Information We Collect

The information we collect depends on how you use the Service and the permissions you choose to grant.

A. Information You Provide

Account Information

To create an account and use the Service, you provide an email address.

We use your email address to:

  • create and maintain your account;

  • send you a verification code that allows you to sign in to the Service;

  • associate your account with your identity within the Service.

When you register, we assign your account a unique account ID. After creating an account, you may choose a nickname or display name to use within the Service.

Your account is directly associated with the email address you used to register.

We do not use passwords for account access. Sign-in is performed using a verification code sent to the email address associated with your account.

Important: You are responsible for maintaining access to the email address associated with your account. If you lose access to that email address, we may not be able to verify that you are the account owner or recover access to your account. In such circumstances, we may be unable to restore access to the account or its associated content.

Content You Create and Upload

The Service allows you to create and organize content through Flips and related content areas.

Depending on the features you use, you may choose to create or upload content such as:

  • photos;

  • videos;

  • audio;

  • captions and other text;

  • links;

  • other media or materials supported by the Service.

You control the content you choose to create and upload. When you create a Flip, you can choose its visibility setting:

  • Private Flips are visible only to you, the creator of the Flip.

  • Public Flips are visible to other users of the Service.

You can choose the visibility of your Flips in accordance with the options available in the Service. You should carefully consider what information you include in a Public Flip, as it may be viewed by any user of the Service.

You are responsible for the content and information you choose to upload or make available through the Service. You should avoid including sensitive personal information or personal information about other people in Public Flips unless you have an appropriate legal basis or their permission to do so.

B. Information Collected Automatically

When you use the Service, we may automatically collect certain technical and usage information necessary to operate, maintain, secure, and improve the Service.

This may include:

  • information about how you use the Service, such as features used, actions taken, and timestamps;

  • device type and model;

  • operating system version;

  • application version;

  • language and regional settings;

  • technical and security-related information, such as your IP address.

We may use this information to operate the Service, maintain security, prevent abuse, troubleshoot technical issues, and improve the Service.

C. Device Permissions

The Service is currently available on iOS through the Apple App Store.

The Service may request access to certain features of your iOS device. You can choose whether to grant these permissions and can change them at any time through your device settings.

Camera

If you grant camera permission, we may access your device's camera when you choose to use camera-related functionality within the Service, such as creating or uploading content.

We do not access your camera when you are not using a feature that requires camera access.

Location

If you grant location permission, we may access your device's location solely to provide location-based features, including displaying weather information relevant to your location.

We do not store your precise location as part of your account or retain it for future use. Location information is used only as necessary to provide the relevant weather feature.

You can disable location access at any time through your iOS device settings. If you do not grant location permission, you may still use the other features of the Service, but location-based weather information may not be available.

D. Information You Choose to Provide Through the Service

Some features of the Service allow you to voluntarily provide additional information through the content you create or upload.

The information you choose to include in your Flips or other content may be visible to other users depending on the functionality and settings of the Service.

Please consider carefully what information you choose to share through the Service, particularly if that information could identify you or another person.

2. How We Use Information

We use information we collect for the following purposes:

Providing and Operating the Service

We use information to:

  • create and maintain accounts;

  • authenticate users;

  • provide access to the Service;

  • store and deliver user-created content;

  • maintain profiles and Flips;

  • provide features requested by users;

  • process device permissions and location-based features;

  • maintain the functionality and performance of the Service.

Personalization and Service Improvement

We may use information about how you use the Service to:

  • personalize your experience;

  • organize or recommend content;

  • improve feed ranking and content organization;

  • understand how users interact with features;

  • identify technical issues;

  • develop and improve existing and future features.

Safety and Security

We may use information to:

  • detect and investigate suspicious activity;

  • prevent fraud, abuse, and unauthorized access;

  • protect user accounts;

  • protect the security and integrity of the Service;

  • enforce our Terms of Use or other applicable terms;

  • investigate violations of applicable law.

Customer Support

We use information you provide to:

  • respond to questions and requests;

  • troubleshoot problems;

  • recover accounts;

  • verify account ownership where necessary;

  • provide customer support.

Legal Compliance

We may process information where necessary to:

  • comply with applicable laws and regulations;

  • respond to valid legal requests;

  • establish, exercise, or defend legal claims;

  • protect our legal rights.

3. Legal Bases for Processing in the EEA, UK, and Other Applicable Jurisdictions

If you are located in the European Economic Area ("EEA"), the United Kingdom ("UK"), or another jurisdiction where a legal basis is required, we process your personal information based on one or more of the following legal grounds, as applicable:

Performance of a Contract

We process information when it is necessary to provide the Service you have requested, including creating and maintaining your account and providing the features of the Service.

Legitimate Interests

We may process information where necessary for our legitimate interests, including:

  • operating and improving the Service;

  • maintaining security;

  • preventing fraud and abuse;

  • protecting our users and systems;

  • understanding Service usage;

  • defending our legal rights.

When relying on legitimate interests, we consider and balance those interests against your rights and freedoms.

Consent

Where required by law, we rely on your consent to process information for specific purposes, such as certain optional device permissions or location-based features.

You may withdraw consent at any time where processing is based on consent. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Legal Obligations

We may process information where necessary to comply with a legal obligation applicable to us.

4. User-Generated Content and Visibility

The Service allows you to create and organize content through Flips.

When you create a Flip, you can choose whether it is Private or Public:

  • Private Flips are visible only to you, the creator.

  • Public Flips are visible to all users of the Service.

You can change a Private Flip to Public at any time. However, once a Flip has been made Public, you cannot change it back to Private. Making a Flip Public is therefore an irreversible action with respect to its visibility setting.

Public Flips and Forwarding

When you make a Flip Public, it may be viewed, collected, or forwarded by other users of the Service.

If another user forwards or otherwise reuses a Public Flip, a copy or reference to that Flip may become part of that user's collection or content within the Service. Such copies or references may remain available even if you later delete or modify the original Flip.

For this reason, you should carefully consider the information and content you include in a Public Flip before making it Public. You should avoid including sensitive personal information, passwords, financial information, precise real-time location information, or personal information about other individuals in a Public Flip unless you have an appropriate legal basis or their permission to do so.

You are responsible for the content and information you choose to create, upload, and make available through the Service.

Deletion of Flips

You may delete Flips and other eligible content through the Service where the relevant functionality is available.

When you delete an original Flip, it will no longer be available as the original Flip through the Service. However, if another user has previously forwarded, collected, or otherwise reused a Public Flip, copies or references to that content may remain available within the Service and may not be automatically removed when the original Flip is deleted.

We may also retain certain information temporarily in backups or other systems where deletion is not immediately technically possible, or where we are required or permitted by applicable law to retain the information.

5. Automated Processing and Algorithms

The Service uses algorithms and automated processes to operate certain features and improve your experience.

These processes may be used to organize, display, or recommend content and to personalize aspects of the Service based on information such as your interactions with the Service and your use of its features.

These automated processes do not use artificial intelligence or machine-learning models.

We may update or improve the algorithms and automated processes used by the Service from time to time as we develop and improve the Service.

6. How We Disclose Information

Where data is transferred from Japan, the EEA, or the UK to service providers located in the United States or other jurisdictions, we rely on recognized legal transfer mechanisms, including European Commission adequacy decisions, the EU-U.S. Data Privacy Framework (where applicable), or Standard Contractual Clauses (SCCs) to ensure your data receives an equivalent level of protection.

If you delete content or request deletion of your account, we will delete or anonymize the relevant information from our active systems within a reasonable period, except where we are required or permitted by law to retain it.

Backups

Deleted information may remain temporarily in backups or disaster recovery systems before being deleted or overwritten in accordance with our backup procedures.

Security and Technical Logs

We may retain security and technical logs for as long as reasonably necessary for security, fraud prevention, troubleshooting, system integrity, and legal purposes.
